Ameri-Dream Realty, LLC (Case Number BK-S-15-10110-GS)

On January 9, 2015, Ameri-Dream Realty, LLC (“Ameri-Dream”) filed a voluntary petition under Chapter 7 of the United States Bankruptcy Code in the United States Bankruptcy Court for the District of Nevada (the “Bankruptcy Court”).  On January 9, 2015, Victoria L. Nelson (“Trustee Nelson”) was appointed as the Chapter 7 Trustee in Ameri-Dream’s bankruptcy case.  On January 19, 2018, Shelley D. Krohn was appointed as the successor Chapter 7 Trustee in Ameri-Dream’s bankruptcy case.  The purpose of this web page is to provide information regarding Ameri-Dream’s recent bankruptcy filing to creditors and other parties-in-interest.

TO ALL INDIVIDUALS/ENTITIES THAT WERE EITHER LANDLORDS OR TENANTS OF REAL PROPERTIES THAT WERE MANAGED BY AMERI-DREAM:

On September 30, 2015, the Trustee filed a Motion For (1) Turnover of Security Deposits Held In Trust Account of McDonald Carano Wilson Pursuant to 11 U.S.C. §542 and (2) Authority to Administer Security Deposits Through the Debtor’s Bankruptcy Estate Pursuant to 11 U.S.C. § 105(a) (the “Motion for Turnover”), which sought to transfer approximately $707,567.29 of the remaining security deposits once maintained by the Debtor and currently held in an IOLTA by the Debtor’s bankruptcy counsel (the “Security Deposits”) to Ameri-Dream's bankruptcy case so that they can be administered for the benefit of  creditors that have filed proofs of claims.  On November 3, 2014, the Bankruptcy Court conducted a hearing on the Motion for Turnover and held that the Security Deposits shall be transferred to the bankruptcy estate fifteen (15) days after the entry of the order granting the Motion for Turnover.

Although the Security Deposits will be transferred to Ameri-Dream's bankruptcy case so that they can be used to pay proofs of claim, no payments will be made to any landlords or tenants that have filed proofs of claims until Ameri-Dream’s bankruptcy case has been fully administered.  A copy of the Order Granting Motion for Turnover that was entered by the Bankruptcy Court on November 6, 2015, can be accessed below:

Nelson v. Elsie Peladas-Brown (Case Number BK-S-15-01087-GS)

On May 21, 2015, the Trustee commenced the adversary proceeding titled Nelson v. Elsie Peladas-Brown (Case Number BK-S-15-01087-LED) (the “Brown Adversary Proceeding”) by filing a complaint in the Bankruptcy Court alleging the following claims for relief: (1) Breach of Fiduciary Duty and (2) Common Law Misrepresentation. The Brown Adversary Proceeding is related to the alleged embezzlement by Elsie Pelada-Brown, the spouse of the Debtor’s principal, of approximately $1,200,000 in security deposits held in trust by the Debtor.  A copy of the Complaint that was filed by the Trustee in the Brown Adversary Proceeding can be accessed below:

Nelson v. XL America, Inc. et al. (Case Number BK-S-15-01183-GS)

On October 29, 2015, the Trustee commenced the adversary proceeding titled Nelson v. XL America, Inc. et al. (Case Number BK-S-15-01183-GS) (the “XL Adversary Proceeding”) by filing a complaint in the Bankruptcy Court  alleging the following claims for relief: (1) Breach of Contract; (2) Breach of Implied Covenant of Good Faith and Fair Dealing; (3) Breach of Fiduciary Duty; (4) Violations of N.R.S. 686A.310; and (5) Declaratory Relief.  A copy of the Complaint that was filed by the Trustee in the XL Adversary Proceeding can be accessed below:
